Notice of CoMHWA SGM

The CoMHWA Board call on members to attend this SGM to approve changes to the Constitution. The Constitution has been carefully reviewed by the CoMHWA Governance Sub-Committee in accordance with advice provided by the Department of Mines, Industry, Regulation and Safety, and Hall & Wilcox lawyers.

Member feedback was sought via our newsletter, website, and social media platforms with a comprehensive list of intended changes, and reasons behind these changes between March and April, 2024.  

These changes are based on the need to foster inclusivity with gender-neutral pronouns, grammar and formatting changes (including removing any repeated information), providing clearer definitions around membership, staff and Board, and removing the section on the Common Seal of Association. Please see Appendix A for a full list of proposed changes.

In accordance with the requirements of the Associations Incorporations Act 2015 it is proposed that the members of CoMHWA adopt by special resolution, the changes outlined in the attached paper. This will ensure compliance with the Act and maintain governance best practice.

At the SGM, our Chairperson will ask for the following question to those in attendance:

Special Resolution: That the Consumers of Mental Health WA Constitution be amended as proposed.

Voting is by show of hands to approve, then reject, and abstain from the vote.

Individual CoMHWA Members or the one nominated Consumer Group CoMHWA Member representative are eligible to vote. If you are unable to attend the SGM, please appoint a delegate as proxy to vote on your behalf.

A proxy form is attached and must be returned to Rebecca via admin@comhwa.org.au by 5pm, Friday 24th May.
